Juba Court stops popular entertainment venue from hosting weddings

The Juba County Court on Tuesday made a ruling prohibiting wedding ceremonies at the popular BMC Hall after Kiir Chol Deng Acuil a lawyer representing residents of Nyakuron filed a case in June against the owners of BMC.

Chol and other concerned residents blamed management of BMC hall for noise poluution.

 “The court has issued permanent injunction, they should not carry on any wedding activities that is the final order of the court, I am not satisfied because I was expecting the court to send them to jail,” Chol told The Juba Echo in Juba.

 “The hall is not licensed by the Juba City Council, they claim that they were given operation license by Juba City Council that was overruled by Juba County Court as inconvenient argument,” he added.

Chol said the presiding judge Nyang Wol ordered the owner of BMC hall, Bol Mawut Deng not to conduct any wedding occasions at the BMC gardens starting from December 12 2023.

 He said the loud music played inside BMC gardens violates order No.3 2023, which was issued by the Juba City Council which prohibits operating music in residential areas.

Section 177 of the 2008 Penal Code Act, says, whoever commits an act or illegal omission which causes any common injury, danger or annoyance to the public or to the people in general who dwell or occupy property in the vicinity or which must necessarily cause injury, obstruction, danger or annoyance to persons who may occasion to use any public right, commits the offences of public nuisance.

The 2013 Juba City Council bylaws as amended 2020, say, any person who owns night clubs and disco place shall operate in locations approved by quarter, block and Juba City Council, acquire license and operation certificate from block council or Juba city council.
